An 1856 Illinois Deed

During the Fall of 1989 I had the occasion to visit Monmouth (Warren County) Illinois. While there Ethel Trego, with whom I had corresponded with for some time, gave me a copy of the following deed, on record at the Warren County Courthouse.

This Indenture Made this seventh day of April in the year of our Lord one thousand eight hundred and fifty six between Daniel Pettit and Letty Low and James E Rainwater and Gabril Rain Water each of the County and State aforesaid and heirs of Levi Rainwater deceased who was a private in Allisons seventh Regiment of Infantry in the Regular Army of the United States in the War of 1812 Parties of the first part and Gain Robinson of Roseville State of Illinois and Solomon King of Andersonville State of South Carolina parties of the second part Witnesseth that the said parties of the first part for and in consideration of the sum of fifty dollars lawful money of the United States of America to them in hand paid by the said Solomon King one of the parties of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have remised released and forever quit claimed and by these presents do remise release sell and forever quit claim unto the said parties of the second part and to their heirs and assigns forever all of their right title and interest with which they may be seized or visted with or in or to all of a certain tract of land situated in the tract appropriated for military bounties in the State of Illinois for the War of 1812 described as follows to wit Being the North East quarter of section fifteen (15) of Township twelve North of the Base line and of Range three (3) West of the fourth principal meridian Containing one hundred and sixty acres more or less and being the same tract Granted by the United Sates to the aforesaid Levi Rainwater a private in Allisons Seventh Regiment of Infantry of the Regular Army of the United States of America in the War of 1812 and by letters patent dated the fifteenth day of December 1818 reverence to which will more fully explain and the said parties of the first part for themselves their heirs and assigns do forever revise relinquish sell and quit claim all their said right title and interest in of or to the above mentioned premises unto the said parties of the second part their heirs and assigns forever To have and to hold the above described premises with all and singular the privileges and appurtenances to the said parties of the second part their heirs and assigns forever In witness Whereof the said parties of the first part have hereunto set their hands and Seals the day and year above written

Before me a Justice of the peace within and for the County and State aforesaid personally appealed John D Pettit who being duly sworn according to the law saith that he did see Daniel Pettit Letty Low James E Rainwater and Gabriel Rainwater, sign seal and deliver the foregoing deed for the uses and purposes therein mentioned and that James P. Wigley was a subscribing witness with himself to the signing of David Pettit and Letty Low and that L. Rodgers was a subscribing witness with himself to the signing of James E Rainwater and Gabriel Rainwater and that said conveyors are the heirs of Levi & Elizabeth Rainwater referred to in the deed above
